We, at FPV Labs (Loonshots Network Pvt Ltd) (“FPV Labs”, “we”, “us”, or “our”) respect your privacy and are committed to protecting your (“Contributor”, “Your”, “User”) Personal Data, Contribution Data and Intellectual Property in connection with your use of our services, supply of content and participation in building our First Person-View (“FPV”) Datasets through our contribution interface such as the mobile application (the “Platform”) and licensed sources. This Privacy Policy (“Policy”) sets out how we collect, use, retain, and share such data.

This Policy forms part and parcel of the Terms and Conditions for our Platform and shall be read as a whole. For ease of reference, any terms used but not defined in this Policy have been defined in our Terms and Conditions.

We reserve the right to modify this Policy, in whole or in part, at any time. Upon making modifications, we will notify you of such changes through the Platform and, if you are a registered contributor, via the email address associated with your account. If you believe that the modifications adversely affect your rights, you may terminate your registration in accordance with the provisions of our Terms and Conditions. Continued use of the Platform following the implementation of any changes constitutes your unconditional acceptance of the updated Policy.

This Policy has been formulated in compliance with applicable statutory requirements, including those required under Indian and US data protection laws.

Purpose

Through this Policy, we aim to provide full transparency regarding our practices in collecting, using, and protecting your Personal Data and ensuring that your privacy is safeguarded while enabling you to participate in the Platform’s FPV dataset creation and associated services.

As Contributors, you acknowledge that Contribution Data, including videos are created specifically for FPV Labs and is not intended to contain any personal data or personally identifiable information. You agree that you will avoid capturing your own identity or the identity of any other individual. If any personal data is incidentally or intentionally included in a Contribution Video, you expressly grant FPV Labs a perpetual, worldwide, irrevocable, royalty-free right to use, process, modify, reproduce, license, commercialise, and otherwise exploit such data without any restriction or limitation. All Contribution Data shall become the property of FPV Labs upon upload, irrespective of whether such data qualifies for compensation, is accepted or rejected, or is voluntarily submitted without expectation of payment.

You undertake that as a Contributor or User on the Platform, you are at least 18 years of age and, where Applicable Law prescribes a higher minimum age for valid consent or contracting, you meet such higher minimum age. FPV Labs does not permit minors to create accounts on its Platform or access its Services.

Our Role

At FPV Labs, we act as the Data Fiduciary (or ‘Controller’) only with respect to your Personal Data that you provide for account creation, authentication, communication, and payments. We do not act as a Data Fiduciary / Controller in relation to Contribution Data because Contributors are expressly instructed not to include any Personal Data in Contribution Data. If any Personal Data is incidentally or intentionally included in Contribution Data, such data will be treated solely as part of the Contribution Data and not as Personal Data. FPV Labs acts as an independent controller of Contribution Data for commercial and product purposes, with full discretion to use, process, commercialise, and license Contribution Data, including derivatives and model outputs, as set out in this Policy and the Terms.

We shall, at our sole discretion, determine the purposes and means of processing all Contribution Data in alignment with our objectives. Specifically, but without limitation, we may:

  • Collect, scrub, filter, anonymise, transform, and curate FPV video contributions, that is, Contribution Data from Contributors;
  • License Datasets (or parts thereof) derived from Contribution Data to enterprises, academic entities, or for open/public purposes under controlled terms;
  • Use anonymised and aggregated data for research, analytics, Artificial Intelligence training and similar purposes;
  • Cooperate with legal authorities and enforce rights and obligations under the Terms and Conditions.

Information We Collect

We collect or process data for lawful and business purposes. We will have access to your information only if:

(a) you provide the information directly to us;

(b) we collect the information automatically when you use the Platform; or

(c) we lawfully obtain the information from a third party.

The following types of data is collected by us:

  • Account and Registration Data: When you register or use the Platform (as a Contributor, or User), we may collect your personal data such as name, email address, phone number, demographic details, location, profile photograph, and any other information provided during account creation. Registration is strictly limited to adult users. By registering, you represent that you are an adult legally capable of entering into this commercial arrangement.
  • Contribution Data: First-person recorded videos, audio, text, images, metadata, tags, First-person videos sourced from publicly available platforms and licensed providers and other contributing data submitted by contributors. Contribution Data must not include personal data of any person. If any personal data is included despite these instructions, the Contributor grants FPV Labs an unrestricted right to use such personal data as part of the Contribution Data. By submitting Contribution Data, you acknowledge that the content is intentionally created for FPV Labs as a work-for-hire contribution, and FPV Labs obtains full commercial rights as set out in this Policy and the Terms.
  • Payment Details: If you are a Contributor being compensated for submitting Contribution Data, you may be required to provide details such as your name, contact details, billing address, and payment account information. Payments may be processed through authorised third-party payment gateways or by FPV LAbs. For this purpose, we may collect payment details (such as credit/debit card numbers, UPI, wallet IDs, or banking information), which you consent to share.
  • Communication: Messages, emails, support tickets, feedback, attachments between you and FPV Labs.
  • Optional Data: Data you choose to submit for optional features, consents, surveys, or preferences.
  • Information Collected Automatically: Device identifiers, IP address, browser type and version, operating system, language settings, pages visited, clicks, session duration, errors, interactions with features, cookies, web beacons, tracking pixels and analytics data.
  • Information from Third Parties: Third-party services integrated via APIs, which you consent to, as part of using the Platform.

Collectively, the above data is referenced as “Data” herein.

Legal Basis and Purpose for Processing

We rely on one or more of the following legal bases for Data collection and processing, depending on your jurisdiction and the context: (i) your consent; (ii) contractual necessity; (iii) compliance with legal and regulatory obligations; and (iv) our legitimate interests in operating and improving the Platform.

FPV Labs’ processing of Contribution Data is based on contractual necessity, as Contributors are either paid for their contribution or do so voluntarily and the transaction is a content-supply arrangement. Since Contribution Data is required to contain no Personal Data, FPV Labs generally does not process Sensitive Personal Data in connection with Contributor uploads. It is clarified that use, licensing, and commercialisation of Contribution Data do not depend on any payment obligation to the Contributor.

The Platform is strictly for adult users. FPV Labs does not knowingly collect data from minors. If any minor submits data, such data will be deleted upon discovery.

How do we use this Data?

In addition to the purposes mentioned above, FPV Labs may use your Data for the following lawful purposes:

  • To register you as a Contributor, or User, and allow access to our Platform and related services.
  • To communicate with you regarding the Services, Dataset updates, modifications to this Policy or the Terms of Use, security notices, or other important announcements.
  • To inform you about new Datasets, features, services, enterprise solutions, events, promotions, and other information we believe may be of interest to you (subject to consent where required).
  • For Contributors, to manage your submissions, process compensation, verify quality and compliance.
  • To use, commercialise, license, reproduce, publicly display, distribute, or otherwise exploit Contribution Data and any anonymised or derivative works thereof, without restriction.
  • To apply anonymisation, annotations, segmentation, metadata, and other processes that improve the Dataset and enable AI training or research use cases.
  • To analyse which areas of the Platform are most used, measure Dataset adoption, and improve the functionality, usability, and overall user experience of the Platform.
  • To prevent, detect, investigate, and take measures against fraud, misuse, unauthorised access, or illegal activity involving the Platform or the Dataset; to enforce compliance with the Terms; and to protect FPV Labs, our users, and third parties.
  • To comply with Applicable Law, defend legal claims (in court, arbitration, or regulatory proceedings), manage risk, or obtain legal and professional advice.
  • For training, quality assurance, internal audits, and recordkeeping to ensure proper functioning of the Platform and Dataset development.
  • To analyse anonymised and aggregated data to improve FPV Labs’ Datasets, tools, and AI features, and to support innovation in FPV Datasets and AI research.
  • For any other purpose disclosed at the time of collection or otherwise authorised under applicable law.

Use of Contribution Data for AI training is a core and essential function of the Platform. Contributors expressly acknowledge that all Contribution Data may be used to train humanoid systems, robotics datasets, AI models, computer vision systems, and similar technologies.

Your choices

FPV Labs respects your rights in relation to your Personal Data; however, such rights are subject to certain limitations necessary for the lawful, secure, and effective operation of the Platform. Since Contributors are explicitly prohibited from submitting personal data, FPV Labs retains full rights over Contribution Data even if Personal Data is inadvertently included.

You may choose not to provide certain Personal Data or request deletion or updates to your Personal Data. However, some Personal Data is essential for registration, Contributor participation, Dataset preparation, and compliance with Applicable Law. Failure to provide or maintain accurate Personal Data may limit or prevent your ability to access the Platform or contribute content.

You may opt out of promotional communications. However, FPV Labs reserves the right to use your Personal Data to send mandatory communications, including but not limited to policy or terms updates, legal and compliance notices, anonymisation or processing confirmations, and information essential to your role as a Contributor. These mandatory communications cannot be limited.

You may request restrictions on how FPV Labs processes your Personal Data. However, FPV Labs retains the right to process Personal Data where necessary to:

  • verify Contributor obligations and compliance;
  • fulfill legal, regulatory, or contractual obligations;
  • exercise or defend FPV Labs’ legal rights. Any restriction may impair your access to certain features or services, and FPV Labs bears no liability for such limitations.

Notwithstanding any request you make, deletion or restriction rights do not apply to Contribution Data. Further, FPV Labs reserves the right to collect, retain, and process Personal Data to the extent required to:

  • comply with Applicable Law;
  • maintain the integrity and commercial value of the Dataset;
  • ensure anonymisation and data security; and
  • protect FPV Labs’ legal rights, property, and users.

Sharing and Disclosure of Information

We share information collected under this Policy only as permitted herein.

Contribution Data:

Contribution Data may be freely used, licensed, commercialised, or publicly released by FPV Labs, and Contributors acknowledge that they have no rights of control, revocation, or limitation over such use. If any personal data is incidentally included in Contribution Data, such personal data will be treated as part of the Contribution Data, and may be used and shared to the same extent.

By uploading Contribution Data, you irrevocably assign, transfer, and convey to FPV Labs all rights, title, and interest in and to the Contribution Data, including all worldwide intellectual property rights therein, for unrestricted commercial use. You waive all moral rights, privacy rights, publicity rights, and similar rights in the Contribution Data, including any rights that may arise from incidental capture of your likeness, surroundings, or voice.

We may share Personal Data with:

  • Employees and Authorised Contractors: Access is limited to those who require the information to perform their duties. All are bound by confidentiality and privacy safeguards.
  • Service Providers and Vendors: We engage third parties (e.g., payment processors, hosting providers, analytics, compliance support) to provide services to us or on our behalf. They may only process your information as instructed and in accordance with this Policy.

Contributor’s Contribution Data (after processing) may be shared with customers, licensed enterprises, research bodies, or released under open-source terms. If any personal data is incidentally included in Contribution Data, such personal data will be treated as part of the Contribution Data, and may be used and shared to the same extent.

Legal and Regulatory Authorities: We may disclose information as required to comply with applicable law, legal process, or government request, or where disclosure is necessary to protect our rights, property, safety, or to prevent misuse, fraud, or unlawful activity.

If we undergo a merger, acquisition, restructuring, or sale of assets, your Personal Data and Contribution Data may be transferred as part of such transaction, subject to this Policy.

We may share anonymised or aggregated usage data with analytics and marketing partners via cookies or similar technologies. This information cannot identify you personally.

FPV Labs may provide attribution to Contributors in metadata or publications, subject to their explicit consent, and always with the option to use an alias or opt out.

Once Contribution Data has been processed, it may be shared, licensed, or published in any form, and Contributors cannot restrict such use.

Contribution Data and Use of Artificial Intelligence

In submitting Contribution Data, you acknowledge that such data becomes the full, exclusive, transferable, and perpetual property of FPV Labs, including all rights in derivative datasets, trained AI models, embeddings, weights, outputs, and annotations. Contributors have no right to request deletion, removal from models, un-training of models, or withdrawal of datasets.

Data Retention

We retain your Personal Data only for as long as is necessary to fulfill the purposes for which it was collected, as described in this Policy, and as required to comply with applicable legal, regulatory, accounting, or contractual obligations. Please note that Contribution Data forms part of FPV Labs’ proprietary datasets and cannot be withdrawn or deleted, irrespective of subsequent account deletion. FPV Labs retains all Contribution Data permanently, whether or not such data was accepted, compensated, or used in any Dataset.

In particular:

Personal Data (Contributor’s account information, payment details, communications, etc.) will be retained for the duration of your relationship with us and for such additional periods as may be necessary to resolve disputes, enforce our Terms, comply with taxation and audit requirements, or to defend against legal claims.

Contribution Data (videos, annotations, and metadata), once submitted, becomes an irrevocable part of our dataset repositories. While FPV Labs may, at its discretion, remove Raw Contribution Data that has not yet been processed, Contributors acknowledge and agree that once their Contribution Data is submitted, such submission is permanent and cannot be undone.

For the avoidance of doubt, Contributors cannot revoke, delete, or restrict their Contribution Data, including any personal data incidentally captured, after it is uploaded on the Platform.

While any Personal Data incidentally captured within Contribution Data may be filtered, scrubbed, anonymised, or minimised over time, the Contribution Data itself (including any such incidental personal data) shall remain the perpetual property of FPV Labs and may be retained indefinitely. Data subject rights under Applicable Law apply only to account-related Personal Data and not to any Contribution Data, including voluntarily submitted or rejected data. You may exercise your rights under the “Your Rights” section with respect to your Personal Data only, which does not form part of Contribution Data.

Your Rights

Depending on jurisdiction, you may have the right to:

  • To request confirmation of whether your Personal Data is being processed and obtain a copy of such data.
  • To request correction of inaccurate or incomplete personal data.
  • To request deletion of your Personal Data, subject to legal and contractual limitations.
  • To request limitation of processing under certain circumstances (e.g., contesting accuracy).
  • Where applicable, to receive your Personal Data in a structured, commonly used, machine-readable format.
  • To withdraw consent for processing Personal Data based solely on consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.
  • To file complaints with the relevant Data protection authority in their jurisdiction.

You have the right to nominate any other individual who shall in the event of your death or incapacity, exercise your rights as provided under this section and in accordance with this Policy.

Requests to exercise these rights may be submitted to our Grievance Redressal Officer (see below). FPV Labs will respond to such requests within the timeframes required under Applicable Law.

Please note that data subject or data principal rights under Applicable Law (including rights of access, correction, erasure, restriction, or portability) apply only to Personal Data provided for your account, profile, payments, or communications, and do not apply to Contribution Data. Once Contribution Data is uploaded, it cannot be returned, undone, reversed, or retracted by the Contributor, regardless of compensation status.

Data Security

We are always committed to protecting the privacy and the confidentiality of your Personal Data. Whenever we obtain Data from you, our Platforms use commercially reasonable efforts and general industry standards to protect it from any unauthorised access or disclosure. Save as otherwise provided in this Policy, access to your Personal Data is limited to the Company’s personnel and such authorised third parties who may host your data on our behalf or may assist us in providing the services. We use best endeavours to maintain physical, electronic and procedural safeguards that aim to protect your Personal Data against loss, misuse, damage, modification, and unauthorised access or disclosure.

Notwithstanding the above, no form or method of data storage or transmission system is fully secure, and we cannot guarantee that security provided by such system(s) is absolute and that your Personal Data will not be accessed, disclosed, or destroyed in the event of a breach of any of our security measures. We cannot guarantee that Personal Data you supply won't be intercepted while being transmitted to us over the Internet. Any transmission of information by you to our Platform is at your own risk. We would inform you of any breach of the system that allows unauthorised access to your Personal Data.

In the event of a Personal Data breach that is likely to result in risk to rights of individuals we will follow applicable law and notify affected users and regulators as required.

Cross-Border Data Transfers

Your data may be transferred outside your country and it is deemed that you consent to it. Contributors expressly consent to the global transfer, storage, and processing of Contribution Data without geographic restriction, including transfers among FPV Labs’ parent company, subsidiaries, affiliates, and other Group Entities. We protect the transfers of Personal Data using mechanisms such as Standard Contractual Clauses, Data Processing Agreements or other safeguards permitted by Applicable Law.

Liability Disclaimer Clause

To the fullest extent permitted by Applicable Law, FPV Labs shall not be liable for any loss, damage, claim, or liability arising from: (i) the Contributor’s inclusion of Personal Data or Sensitive Personal Data in Contribution Data despite explicit instructions not to do so; (ii) any inability to delete, remove, or revoke Contribution Data once incorporated into Datasets, models, or derivative works; (iii) unauthorised access, disclosure, alteration, or destruction of Contribution Data or Personal Data arising from factors beyond FPV Labs’ reasonable control; or (iv) any use, processing, licensing, or commercialisation of Contribution Data in accordance with these Terms and this Policy.

FPV Labs’ liability for any claims arising out of Personal Data (and not Contribution Data) shall be limited to the extent and amounts specified in the Platform’s Terms and Conditions.

Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India, and the courts at Bengaluru shall have exclusive jurisdiction. Any disputes shall relate solely to Personal Data and shall not affect FPV Labs’ ownership or rights in Contribution Data.
